Charter & transport agreements

Charter and transport agreements are key components of the transport and logistics industry, governing the contractual relationships between parties involved in the transportation of goods and logistics services.

Transport agreements cover contractual framework for the transportation of goods and can be modelled dependant on the mode of transportation, such as road, rail, air, sea or multimodal. Transport agreements provide a framework for the efficient transportation of goods and help ensure that both the shipper and the carrier have a clear understanding of their roles, obligations, and responsibilities. These agreements typically include details such as scope of services, rates, payment terms, volumes and capacity, liability, insurance, applicable law and regulations and disputes.

Charter agreements entail the contractual framework for subcontracting transport operations. This type of agreement outlines the terms and conditions under which the subcontractor will provide transport services on behalf of the principal service provider. Charter agreements provide flexibility and allow businesses to tailor the transportation arrangements to their specific needs. Next to general provisions on freight prices, payment terms, capacity, exclusivity, non-compete, liability, etc., the charter agreement will contain provisions on the usage of trailers belonging to the principal service provider, insurance and respect for the applicable social security and labour laws, transport regulations such as transport licences, driving and resting times, obligations of return of the trucks and drivers, etc.
