Driving & resting times
Regulations on driving and rest times and the use of the tachograph are enshrined at European level in Regulations 561/2006 and165/2014. This does not only concern the driver's driving hours, but also, for example, his return rights or the organisation of the company.
These regulations have social, administrative and criminal law aspects and are decisive for everyone in road transport, not least because of the very thorough checks carried out on compliance with them in the European member states.
However, defence in the event of infringements is in ITL Attorneys' core DNA, both at home and abroad and in both road and company inspections. Our lawyer-specialists have already written books on the subject and had various aspects of the regulations on driving and rest times and the use of the tachograph device subjected to the scrutiny of the European Court.
Furthermore, due to our many years of experience in road and company inspections, our specialists know exactly what an inspector checks for. As many companies increasingly need a legally compliant and sustainable business process, ITL Attorneys has developed various audits to identify the various risks involved in road and company inspections. We not only look at the current situation objectively, but also through the lenses of the various inspection and compliance bodies. But instead of imposing sanctions, we then support you in improving your operations and organisation so that - when the inspection services actually come to inspect you - you can rest assured that your organisation is compliant with laws and regulations.
